SARS: Apply Owl Eyes When Handling Your Tax Matters
A new draft legislation proposes to remove the ‘intention’ concept from tax crimes which means you can break the law without you knowing it or without you intending to do so when it comes to SARS.
This results in harsh punishment and could include jail time up to two years.
The prosecutors do not have to prove that you wilfully broke the law and one could be found guilty of an offense even if it were unintentional.
Instances where you can be found guilty:
- Negligence to notify SARS of a change in registered details
- Did not submit your return or requested documents
- Did not respond to a request from SARS or
- Did not pay taxes when it was due.
